| EMPLOYMENT LAW Employment law has been formulated to improve the employment contract system and to build and maintain stable and healthy relationships between an employer and their employees. This law helps to protect the interests and rights of the workers and their duties and responsibilities towards the employer. Employment law is applicable to all businesses with employees. The employment law contract must comply with the fundamental principles of contract law, the provisions of the contract must be based on fairness, lawfulness, freewill, and negotiation. In order for both employer and employee to have a functional relationship in the workplace, each will have to follow the rules as prescribed by law in order to run the business smoothly. Employment sets out the backbone of principles of which all employers in England and Wales must abide by as a minmum requirement for all employees. Such principles or rights include holiday entitlement, maternity, paternity and adoption leave, sick pay, health and safety, minimum wage and working hours. Minimum wage applies to everybody. The rate varies depending on your age range but has been effective as it has helped to combat employers overburdening employees with excessive work for little pay. Employment Contract When you hire employees you will need to have an employment contract to meet your UK legal obligations. The law states that within two months of hiring employees you must give them an employment contract. You have to prepare this document and give it to your full or part time employees as well as permanent and temporary employees. It is best to choose a company that sells the employment contract template that has been prepared by a UK solicitor. If you choose a company that does this you can be sure that it is meeting all the requirements for the UK, and it will provide you with peace of mind. The employment contract should contain the details of the employment. It needs to have a summary of the basic terms of employment such as the pay rate, hours that the employee is expected to work, any holidays that are required to be worked, and how termination will be handled. If you choose the right employment contract template you will be able to customise it to suit your business needs. The only things that you can’t change are the legal requirements that the UK imparts regarding employment. If you are hiring many new employees you could state some of the job requirements in the job offer letter first. This would be acceptable until you are ready to give your employees the employment contract. Many business owners do this very thing as part of their probationary period for new employees. This allows you to inform the new hire of their job descriptions at the time of the employment offer, but saves you from having to initiate the employment contract if the employee doesn’t meet your requirements. Then you can have the employee contract done in time before the two month period has ended. There is no way that you can be exempt from giving your employees an employment contract after the two month period according to UK law. To simplify your life it is best to get the employment contract template downloaded to your computer so that you can have them on hand when you need them. Since there is always employee turnover you can be ready to hire new employees and have the UK law requirements on hand.
